BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHATTANOOGA, TENNESSEE, That there be and is hereby closed and abandoned an alley located southeast from East 34th Street, between Rossville Boulevard and Clio Avenue, more particularly described herein, and as shown on plat attached hereto and made a part hereof by reference: A 10 foot and 15 foot wide alleyway beginning on the southeast line of East 34th Street 128 feet northeast of the intersection of the southeast line of East 34th Street with the northeast line of Rossville Boulevard (as now widened), said point being the northeast corner of lot 119, Clifton Hills Addition No. 1, as shown by plat of record in plat book 6, page 17, ROHC, thence northeast 10 feet with East 34th Street to the northwest corner of lot 104, said Clifton Hills Addition, thence southeast some 366 feet with the southwest line of lots 104-111, said subdivision, to the intersection of the southwest line of lot 111 with the northeast line of the East End Land Company's Addition No. 1, as shown by plat of record in plat book 2, page 22, ROHC, thence southeast some 5 feet with the northeast line of said East End Land Company's Addition to the northwest corner of lot 14, block 71, said subdivision, thence southeast some 337 feet with the southwest line of lot 14, 13, 12, 11, 10, and 9, block 71, to the northwest line of East 35th Street, thence southwest 15 feet with East 35th Street to the southeast corner of lot 8, block 71, said East End subdivision, thence northwest 700 feet with the northeast line of lots 8, 7, 6, 5, 4, 3, and 2, block 71, said East End Land Company's Addition, and continuing with the northeast line of lots 113-119, said Clifton Hills Addition, to the southeast line of East 34th Street, the point of beginning. Tax Map No. 168A-C-1-19. SECTION 2. BE IT FURTHER ORDAINED, That this closure and abandonment is made subject to the following conditions: 1. The reservation for Jupiter Industries, Inc., d/b/a Chattanooga Gas Company, of an easement the width of the streets for its gas main, lines and other distribution facilities located within the petitioned rights-of-way, which must be maintained for the use and benefit of its customers. 2. The City of Chattanooga has a sewer located within said right-of-way and reserves an easement the width of the right-of-way for the purpose of maintaining said sewer. 3. The areas reserved for utility easements must be kept free and clear of all structures. 4. All existing easements are retained. SECTION 3. BE IT FURTHER ORDAINED, That this Ordinance shall take effect two weeks from and after its passage as provided by law.
